| The DHHS has issued a new report titled Hospital Reporting of Deaths Related to Restraint and Seclusion. According to the report, hospitals are not always properly reporting deaths related to restraint or seclusion of patients to CMS.
Currently, The Patients’ Rights Condition of Participation contains a reporting requirement for all hospitals to report deaths associated with the use of restraint or seclusion for behavior management (42 CFR § 482.13(f)(7)).
