| Since the release of the Centers for Medicare and Medicaid's (CMS) final rule on patient rights in December 2006, there has been discrepancy between the CMS and The Joint Commission's (TJC) restraint and seclusion requirements. According to TJC, CMS requirements for restraint and seclusion are behavior based while TJCs standards are purpose driven.
