| The Centers for Medicare & Medicaid Services (CMS) has recently issued a revised State Operations Manual Appendix V regarding EMTALA. As a part of the revised appendix, CMS clarified interpretive guidance concerning EMTALA medical screening examinations (MSE). If a hospital has an EMTALA obligation, it must screen individuals to determine if an emergency medical condition (EMC) exists.
